Travel procurements made by SUPERTRAMP GmbH ? Das junge Reisebüro ? Travel Agency of Austrian Youth Hostels Association - (hereinafter referred to as SUPERTRAMP GmbH) are subject to the terms and conditions set forth in this agreement as such regulating the legal relationship between the CUSTOMER and SUPERTRAMP GmbH. SUPERTRAMP GmbH is solely operating as agent ? except for particular cases when acting as operator and acting on behalf and for account of Austrian Youth Hostels Associations, the funding agency, respectively.
SUPERTRAMP GmbH is contractually obliged to properly procure individual booked tourist services. SUPERTRAMP?s rendering such services is not part of its contractual obligations.
1. BOOKINGS
Any and all bookings must be received by SUPERTRAMP GmbH in writing (i.e. via fax, letter or e-mail). The CUSTOMER accepts the booking and cancellation terms and conditions set forth in this agreement by making a reservation in writing. The CUSTOMER also registers any participating travellers and will be held accountable for his and their contractual obligations. The procurement contract is concluded only when the appropriate booking confirmation is issued in writing by SUPERTRAMP GmbH, to be send to the CUSTOMER within 48 hours (two working days) if feasible, therein reconfirming any prices.
2. LIST OF NAMES / GROUP DETAILS:
The CUSTOMER is obliged to transmit a reconfirmation of group details to SUPERTRAMP GmbH no later than 6 (six) weeks prior to arrival. SUPERTRAMP GmbH does not assume liability for unreported booking errors.
3. MINIMUM NUMBER OF PARTICIPANTS
For youth hostels:
10 persons
For hotels:
20 persons
In case the number of participants should be amended in arrears, SUPERTRAMP GmbH is expressly entitled to modify the prices as stated in the booking confirmation.
4. PRICES
Any and all prices quoted are gross prices (including VAT) per person and night or per bus or per tour guide. Any and all prices are quoted in EURO. Prices do not comprise commission. SUPERTRAMP GmbH concedes one free spot pertaining to bed and breakfast per 21 or 26 participants, respectively. This offer is not valid for bookings of youth hostels and bookings in neighbouring countries of Austria. Any and all free spots strictly pertain to double and shared bedrooms per person and night on a bed and breakfast basis. SUPERTRAMP GmbH expressly reserves the right to additional charges for one-night-groups which will be quoted in the particular offer. Price adjustments due to misprints, exchange rate change and changes during the year are reserved.
5. TERMS OF PAYMENT:
Promptly after receipt of the booking confirmation a down payment of 25% of the (gross) total booking price is to be transferred by immediate wire to the account of SUPERTRAMP GmbH. The final payment is to be wired no later than 6 (six) weeks prior to arrival. In case the travel price is not paid on time, SUPERTRAMP GmbH is not obliged to fulfil its contractual obligations. Particular booking, cancellation and payment terms and conditions apply to new customers, special arrangements and dates, and cross-country-bookings. Any and all money transfers must be wired to the account of SUPERTRAMP GmbH as listed in the booking confirmation.
6. CANCELLATION TERMS AND CONDITIONS
SUPERTRAMP GmbH has to be notified in writing on any booking cancellations. Cancellations are deemed valid when received by SUPERTRAMP GmbH in writing and confirmed by SUPERTRAMP GmbH. Cancellations are subject to the fees set forth hereunder.
a) CANCELLATION OF YOUTH HOSTELS BOOKINGS:

30 days to 15 days prior to arrival:
50% of the total amount
14 days to 4 days prior to arrival:
75% of the total amount
3 days to the day of arrival:
100% of the total amount
In some cases all expenses in respect to the first, or the first three nights, respectively, will be charged.
b) CANCELLATION OF HOTEL BOOKINGS:

Cancellation fees may be waived if spots can be sold to a different travel group. An allowance will be charged for short notice (up to 3 days) abatements of participants.
For cancellations and the expenses connected therewith SUPERTRAMP GmbH charges a processing fee of Euro 30,00 per group minimum.
7. AMENDMENTS
Amendments to the booking and cancellation terms and conditions require an express agreement in writing by and between the parties to the contract in order to be legally effective.
8. LIABILITY
SUPERTRAMP GmbH is liable to the CUSTOMER for proper procurement in compliance with the diligence of a prudent business man. Liability is limited to intent and gross negligence as well as to the price of services procured.
9. VALIDITY
The invalidity of individual booking and cancellation provision does not affect the legality and validity of the remaining provisions. The invalid provision is to be substituted by a valid and in terms of spirit and purpose best similar provision.
10. GOVERNING LAW AND JURISDICTION
The procurement contract and all legal relationships between SUPERTRAMP GmbH and the CUSTOMER are governed by Austrian law. Any disputes shall be solved by the competent court in Vienna.
